ARTICLE IX  -  STATEMENT OF DUE PROCESS FOR STUDENTS

The Board of Trustees of Edgecombe Community College officially declares that all students have the right of due process of law as supported by the Fourteenth amendment to the Constitution of the United States, with the approval of the following procedures:

Part 1. Disagreement of Decisions

Students who feel they have a grievance should first seek to resolve the complaint by discussion with the specific faculty, staff, or administrative member involved.  A demonstration of good faith by all parties in attempting to resolve complaints should be paramount.  If this discussion fails to resolve the issue, students may file a formal grievance.  Students may discontinue the grievance process at any time.

Every reasonable attempt should be made to resolve informally any dispute between students and the college at the level at which the dispute arises.  Recognizing that suchmatters cannot always be resolved informally, ECC provides a formal process throughwhich students can appeal the application of certain college rules and regulations andthe assignment of final grades.  In all cases, it is the intent of the college to assure the fair and equitable treatment of students.  For the full policy, refer to the Student Handbook.


Part 2. Civil Rights Complaints

1. Students who feel that they have been deprived of their civil right shall confer with the College's Affirmative Action Officer who will attempt to resolve the complaint.

2. If the Affirmative Action Officer is unable to achieve resolution of the complaint, the student may appeal directly to the President of the College. The decision of the President is final.

3. The President shall notify the Board of all Civil Rights Complaints and final decisions.
